There is a little known rule 188 in the Highway Code and plenty of people have never heard of it
Welsh motorists are being alerted about a little-known road regulation that could result in a £100 fine and three points on their licence without them even being aware. Rule 188 of the Highway Code appears to have been overlooked by some road users, some people in the industry say.
The legislation concerns the proper use of mini roundabouts. It specifies that all vehicles must pass around the central markings of a mini roundabout, except for large vehicles that are physically incapable of doing so.
Whilst this regulation may seem straightforward to some, many drivers tend to disregard it – often driving straight over the white circle instead, particularly if it’s flush to the ground. Managing director at Select Van Leasing, Graham Conway, said: “It might seem harmless to drive over the central markings of a mini roundabout, especially when they’re level with the road, but doing so is against the Highway Code and can lead to penalties.
“More importantly, though, it can cause confusion and increase the risk of accidents.
“This regulation is in place to ensure smooth traffic flow and safety.
“The central marking, even if painted flat, represents a physical boundary that vehicles are required to navigate around.”
The penalties for failing to comply with this rule can differ, and whilst specific fines aren’t outlined, motorists can face charges for careless or inconsiderate driving if their behaviour is considered dangerous.
This can result in a fixed penalty of £100 and three points on the driver’s licence.
The Highway Code also recommends that drivers approach mini roundabouts in the same way as they would larger ones, with suitable speed and caution.
Motorists are urged to familiarise themselves with the Highway Code and ensure they’re adhering to best practices when navigating all types of roundabouts.
Mr Conway stated: “Careless or inconsiderate driving can mean a range of things, including not following road layouts as intended.
“By not navigating around the central markings of a mini roundabout, drivers risk being penalised.”
